The policies below govern your use of BodyMap, the sale of our personalized plans, and how we handle your information. They apply whether you access BodyMap from the United States, the European Union, or elsewhere.
01Medical & Health Disclaimer
Read carefully. Your safety depends on it.
BodyMap is not medical advice. The nutrition and training plans we generate are intended for general educational and informational purposes only. They are not a medical diagnosis, prescription, treatment, or cure for any disease, condition, or injury. They do not constitute medical nutrition therapy, dietetic practice as defined under any state or national licensing regime, or physical therapy.
Consult a licensed physician before starting, modifying, or discontinuing any nutrition, supplement, exercise, or lifestyle program — particularly if you:
- are pregnant, breastfeeding, or trying to conceive;
- are under 18 years of age (BodyMap is for adults 18+ only);
- have a known or suspected heart condition, high blood pressure, diabetes, kidney or liver disease, eating disorder, or any chronic illness;
- are recovering from surgery, injury, or illness;
- experience chest pain, dizziness, loss of consciousness, or other symptoms of concern during exercise;
- take prescription medication that could be affected by dietary changes or exercise;
- have food allergies or intolerances (even if listed in your profile — always cross-check every ingredient).
Stop immediately and seek medical attention if you experience pain, shortness of breath, dizziness, nausea, or any other warning sign during workouts or after meals.
Individual results vary
Any results, outcomes, or testimonials displayed on our website reflect the experience of individual customers. They are not typical or guaranteed. Your results depend on your starting point, adherence, genetics, medical history, sleep, stress, environment, and many factors outside BodyMap's control.
AI-generated content
Plans are generated by an artificial intelligence model trained on general nutrition and fitness principles. While we design prompts carefully and validate outputs, AI systems can produce errors or omissions. Always use your judgment and consult professionals as needed.
By using BodyMap, you acknowledge that you have read and understood this disclaimer and voluntarily assume all risks associated with following the plan.
02Terms of Service
The agreement between you and BodyMap SRL.
2.1 Acceptance
By accessing, browsing, or using bodymap.health (the "Site") or purchasing any BodyMap product (the "Service"), you agree to these Terms of Service (the "Terms") and all policies referenced in them. If you do not agree, do not use the Site or Service.
2.2 Eligibility
You must be at least 18 years old and legally able to enter into a binding contract. By using BodyMap, you represent and warrant that you meet these requirements.
2.3 Account & accuracy of information
You agree to provide accurate, current, and complete information during the questionnaire and at checkout, and to keep it updated. You are responsible for the accuracy of the health-related information you submit; we build your plan on that basis.
2.4 License to the PDF plan
Upon successful payment and delivery, BodyMap grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable license to use your personalized PDF plan for your own, non-commercial use. You may not republish, resell, share publicly, or distribute the plan to third parties, in whole or in part, without our prior written consent.
2.5 Intellectual property
All content on the Site (text, graphics, logos, images, software, prompts, templates) is owned by or licensed to BodyMap SRL and protected by Romanian, European Union, and international copyright and trademark laws. "BodyMap" and the BodyMap logo are trademarks of BodyMap SRL.
2.6 Prohibited conduct
You agree not to:
- use the Service for any illegal purpose or in violation of any applicable laws;
- scrape, copy, reverse-engineer, or reuse our content or outputs to build a competing service or AI model;
- attempt to gain unauthorized access to the Site, its systems, or other users' information;
- interfere with or disrupt the Service, its servers, or networks;
- submit false, fraudulent, or misleading information, including during payment;
- impersonate any person or entity.
2.7 Third-party services
We rely on third-party service providers listed in our Privacy Policy (e.g., Shopify for payments, Anthropic for AI generation). Their services are governed by their own terms. We are not responsible for the availability, accuracy, or performance of third-party services.
2.8 Warranty disclaimer
The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of AI-generated content. We do not warrant that the Service will be uninterrupted, error-free, or that it will meet your specific health or fitness goals. To the maximum extent permitted by applicable law, all implied warranties are disclaimed.
2.9 Limitation of liability
To the maximum extent permitted by law, BodyMap SRL, its directors, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of profits, data, goodwill, or injury — arising from or related to your use of the Service, even if advised of the possibility of such damages. Our total aggregate liability for any claim shall not exceed the greater of (a) the amount you actually paid to BodyMap in the twelve (12) months preceding the claim, or (b) USD 100.
Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot be excluded under applicable consumer protection law.
2.10 Indemnification
You agree to indemnify, defend, and hold harmless BodyMap SRL from any third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or the rights of a third party.
2.11 Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or if required by law. Sections that by their nature should survive (IP, disclaimers, limitation of liability, indemnity, governing law) will survive termination.
2.12 Force majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, war, terrorism, pandemic, labor disputes, internet or infrastructure failures, and actions of third-party providers.
2.13 Governing law & jurisdiction
These Terms and any dispute arising from them are governed by the laws of Romania, without regard to conflict-of-law rules. The competent courts of Romania shall have exclusive jurisdiction, except that:
- nothing in this section deprives a consumer of the protections granted by mandatory laws of their country or state of residence that cannot be waived by contract;
- US consumers retain all rights and remedies available to them under their state's consumer protection laws.
2.14 Changes
We may modify these Terms from time to time. Material changes will be announced on the Site or by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
2.15 Severability & entire agreement
If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. These Terms, together with the policies referenced in them, form the entire agreement between you and BodyMap SRL regarding the Service.
03Terms of Sale
How the purchase works.
3.1 Product
BodyMap sells a single digital product: the BodyMap 7-Day Personalized Plan (the "Plan"), a downloadable PDF generated from the information you provide in the questionnaire. The current price is USD 4.88, one-time payment. Applicable taxes (where required) are displayed at checkout.
3.2 No subscription
BodyMap currently offers no subscription, auto-renewal, or recurring charges. Every purchase is a one-time transaction. If we introduce subscriptions in the future, clear disclosures and cancellation controls will comply with the FTC "Click-to-Cancel" rule and similar state requirements.
3.3 Payment
Payments are processed securely through Shopify Payments (powered by Stripe), Apple Pay, Google Pay, or PayPal. We do not store your full card number on our servers. By purchasing, you authorize the charge and represent that you are the authorized holder of the payment method.
3.4 Delivery
Your PDF Plan is delivered by email, typically within 5–15 minutes after payment confirmation. Delivery time is an estimate, not a guarantee. If you have not received your Plan within 60 minutes, check your spam folder and contact support@bodymap.health.
3.5 Chargebacks
If you are unhappy with your order, please contact us first — most issues are resolved within one business day. Initiating a chargeback without first contacting us may result in account suspension and the forfeiture of any pending refund.
3.6 Taxes
Where sales tax, VAT, GST, or other taxes apply by law, they will be calculated and displayed at checkout. You are responsible for any taxes not collected at checkout that may apply in your jurisdiction.
04Refund Policy
14-day satisfaction guarantee.
We want you to feel confident with your purchase. You may request a full refund within fourteen (14) days of the date your Plan is delivered to your email, for any reason, subject to the conditions below.
How to request a refund
Email support@bodymap.health with the subject line "Refund request" and include:
- the email address used at checkout;
- your Shopify order number;
- a brief note on why the Plan didn't work for you (optional but helpful for us to improve).
Processing
Refunds are issued to the original payment method within 5–10 business days after approval. Depending on your bank, it may take additional time for the funds to appear.
Conditions
- Refund requests submitted after the 14-day window may be denied at our discretion.
- We reserve the right to decline refunds in cases of suspected abuse (e.g., repeated refund requests from the same customer, evidence of full plan usage combined with a refund request).
- If a chargeback is initiated before contacting us, a separate refund will not be issued once the chargeback is resolved.
Nothing in this policy affects statutory rights you may have under applicable consumer protection laws, including rights granted to consumers in the European Union or under US state law.
05Privacy Policy
How we collect, use, and protect your information.
5.1 Who we are
The data controller for your personal information is:

- Identity & contact: first name, email address.
- Body & health profile: age, biological sex, height, weight, primary goal (fat loss, muscle gain, etc.), activity level, dietary preferences, allergies and intolerances, food dislikes, training experience, available equipment, session length.
- Order & payment: order number, amount, payment method type (full card numbers are processed by Shopify/Stripe and are not stored by us), billing country.
- Technical: IP address, browser user-agent, device type, pages viewed, date/time of visits; cookies and similar technologies (see Section 8).
- Communications: your emails to us and our responses.
5.3 How we use your information
- to generate, deliver, and improve your personalized Plan;
- to process payments and issue invoices;
- to provide customer support and respond to your requests;
- to send transactional emails (order confirmation, delivery, refund status);
- to send marketing emails — only if you have opted in (you can unsubscribe at any time);
- to prevent fraud and abuse, and to secure the Site;
- to comply with legal obligations, including tax and accounting obligations under Romanian law.
5.4 Legal bases (GDPR)
We process your data on the following bases:
- Contract — to deliver the Plan you purchased;
- Consent — for processing health-related data, marketing emails, and optional cookies;
- Legal obligation — for invoicing and tax records;
- Legitimate interests — to secure the Site, prevent fraud, and improve the Service, balanced against your rights.

We do not sell your personal information. We only share what is necessary for each provider to perform its service under a written data processing agreement.
5.6 International data transfers
Several of our providers are located in the United States. Where we transfer personal data outside the European Economic Area, we rely on Standard Contractual Clauses (SCCs) approved by the European Commission, and on the EU-US Data Privacy Framework where the provider is certified. Additional safeguards are implemented as required.
5.7 Retention
- Order data (invoices, receipts): retained for 10 years, as required by Romanian accounting law.
- Account & questionnaire data: retained for up to 24 months after your last purchase or interaction, then deleted or anonymized.
- Marketing data: retained until you unsubscribe, then for up to 6 months for suppression/compliance purposes.
- Support communications: retained for up to 36 months.
5.8 Your rights (GDPR)
If you are in the EU/EEA or the UK, you have the right to:
- access the personal data we hold about you;
- correct inaccurate data;
- request erasure ("right to be forgotten");
- restrict or object to processing;
- data portability;
- withdraw consent at any time;
- lodge a complaint with a supervisory authority — in Romania, the National Authority for the Supervision of Personal Data Processing (ANSPDCP).
To exercise any right, email privacy@bodymap.health. We respond within 30 days.
5.9 Security
We implement reasonable technical and organizational measures to protect your data, including HTTPS encryption, access controls, and processor agreements. No system is 100% secure; in the event of a breach affecting your rights, we will notify you and the relevant authorities as required by law.
5.10 Children
BodyMap is not intended for individuals under 18. We do not knowingly collect personal data from children. If you believe a child has provided us with information, contact us and we will delete it.
06California Privacy Notice (CCPA/CPRA)
For California residents.
This section supplements our Privacy Policy for consumers residing in California, as required by the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA/CPRA").
6.1 Categories of personal information we collect
- Identifiers: name, email, IP address.
- Commercial information: purchase history.
- Internet or network activity: pages visited, interactions with the Site.
- Sensory / inferences: none.
- Sensitive personal information: health-related information you provide in the questionnaire (weight, goals, allergies, etc.). We use sensitive personal information only for the purposes listed in Section 5.3 and do not use it to infer characteristics about you beyond generating your Plan.
6.2 Sources
Directly from you (questionnaire, checkout), automatically (cookies, server logs), and from our service providers (order information from Shopify).
6.3 Sale & sharing
We do not "sell" personal information as that term is defined under CCPA, nor do we "share" personal information for cross-context behavioral advertising. We have not done so in the past 12 months and do not plan to.
6.4 Your California rights
- Right to know what personal information we have collected, used, disclosed, and sold or shared;
- Right to delete personal information we hold about you;
- Right to correct inaccurate personal information;
- Right to opt out of the sale or sharing of personal information (not applicable — we do not sell or share);
- Right to limit the use of sensitive personal information;
- Right to non-discrimination for exercising your rights.
6.5 How to exercise your rights
Email privacy@bodymap.health with the subject "California Rights Request". We will verify your identity using the email address on file and respond within 45 days (extendable by 45 days if necessary). You may authorize an agent to act on your behalf; we may require written authorization and proof of identity.
6.6 "Shine the Light"
California residents may request information about disclosures of personal information to third parties for their direct marketing purposes. We do not share personal information with third parties for their own direct marketing purposes.
07Washington Consumer Health Data Notice
For Washington State residents — under the My Health My Data Act (MHMDA).
If you are a resident of Washington State, this section applies to the "consumer health data" we collect about you, in addition to our Privacy Policy.
7.1 Consumer health data we collect
- biometric data you provide: height, weight, age, biological sex;
- health goals and diagnoses context: fitness objective (fat loss, muscle gain, maintenance, weight gain);
- diet, allergies and intolerances, food dislikes;
- activity level, training experience, available equipment, session length;
- inferences from the above, solely to generate your Plan.
7.2 How we use consumer health data
Only to generate, deliver, and support your personalized Plan. We do not use it for advertising, profiling for marketing, or any other purpose without your explicit consent.
7.3 With whom we share it
Only with the processors required to deliver your Plan: Vercel (hosting), Make.com (automation), Anthropic (AI generation), PDFMonkey (PDF generation), Klaviyo (email delivery). None of these processors use your health data for their own purposes, under contract.
7.4 Consent
We collect and process consumer health data only with your explicit, separate consent, obtained during the questionnaire before you submit it. You may withdraw consent at any time by emailing privacy@bodymap.health. Withdrawal does not affect the lawfulness of processing carried out before withdrawal.
7.5 Your MHMDA rights
- to confirm whether we collect, share, or sell your consumer health data;
- to access your data and receive a list of third parties with whom it has been shared;
- to withdraw consent to collection or sharing;
- to have your consumer health data deleted (including from our processors);
- to appeal a denied request.
7.6 No sale of health data
BodyMap does not sell consumer health data. If this ever changes, we will obtain valid authorization as required by MHMDA.
7.7 How to exercise your rights
Email privacy@bodymap.health with the subject "MHMDA Request". We respond within 45 days. You may appeal a denial to the same address within 60 days; if still denied, you may contact the Washington State Attorney General.
09Accessibility Statement
Our commitment to an inclusive experience.
BodyMap is committed to making its Site usable by everyone, including people with disabilities. We aim to meet the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA and to continuously improve accessibility.
Feedback & assistance
If you encounter an accessibility barrier, or would like assistance using the Site or purchasing a Plan, please email accessibility@bodymap.health. We will respond within a reasonable time, and where requested, we can provide our content in an alternative format.
Third-party limitations
Parts of the purchase experience are delivered through Shopify. We rely on Shopify's own accessibility efforts for that portion of the journey.
10DMCA Notice
Copyright protection.
BodyMap respects intellectual property rights. If you believe that material on the Site infringes a copyright you own or control, please send a written notice to legal@bodymap.health that includes:
- identification of the copyrighted work claimed to be infringed;
- identification of the material that is claimed to be infringing, with enough detail for us to locate it;
- your contact information (name, address, phone, email);
- a statement that you have a good-faith belief that the use is not authorized;
- a statement, under penalty of perjury, that the information is accurate and that you are authorized to act for the copyright owner;
- your physical or electronic signature.
We will investigate and take appropriate action, including removing infringing material where justified. We may forward your notice to the person who posted the material.
11Changes to These Policies
How we communicate updates.
We may update these policies from time to time to reflect changes in our Service, technology, legal requirements, or business practices. When we make material changes, we will update the "Last updated" date at the top and, where appropriate, notify you by email or through a prominent notice on the Site before the changes take effect. Your continued use of BodyMap after the effective date constitutes acceptance of the updated policies.
